The Environmental Protection Agency's inspector general announced Tuesday an investigation into the agency's response to the February 2023 train derailment in East Palestine, Ohio. The probe follows pressure from local residents and Vice President JD Vance, who requested a review of the EPA's handling of the worst U.S. rail disaster in more than a decade.
Derailment and Emergency Response
A Norfolk Southern freight train derailed near the Ohio-Pennsylvania border after a bearing failure. An assortment of chemicals spilled and ignited. Three days later, officials conducted a "vent and burn" operation on five rail cars containing vinyl chloride, releasing a massive black plume that drifted across several states. The National Transportation Safety Board later determined the controlled burn was unnecessary.
Health Concerns and Resident Advocacy
Residents like Jami Wallace have tracked more than 80 cancer cases in the area since the derailment, though direct links remain difficult to prove. Wallace and others pushed the EPA to test for dioxins and continued demanding accountability. "We're not going to stop when you poison our kids," Wallace said.
Scope of the Investigation
The inspector general's office will assess whether the EPA fulfilled its responsibilities and had sufficient data to support public assurances that no toxic chemical levels lingered. Testing experts have questioned whether the agency's data obscured risks from exposure to a mixture of chemicals, rather than single substances.
Ongoing Legal and Corporate Developments
Norfolk Southern agreed to a $600 million class-action settlement with residents, but funds remain tied up in court amid allegations of mishandling by the settlement administrator. A separate federal settlement proposing a $15 million fine and $55 million for long-term medical monitoring and groundwater testing has awaited judicial approval for over two years. The railroad is also pursuing an $85 billion merger with Union Pacific, which faces extensive regulatory review.
