Australian Court Orders Life Without Parole for Mushroom Poisoning Killer

By Karim Hammam

An Australian appeals court has ordered Erin Patterson to spend the rest of her life in prison for poisoning four of her estranged husband's relatives with death cap mushrooms, dismissing her appeal and removing a 33-year non-parole period that would have made her eligible for release at age 82.

Appeal Dismissed, Non-Parole Period Removed

The three judges of the Victoria state Court of Appeal upheld prosecutors' challenge to the leniency of the original sentence, ruling that the "shocking criminality" of the case warranted life without parole. Justice Stephen McLeish said the offending was "extraordinarily cold and calculated" and that a non-parole period was inappropriate.

Second Woman in Australia to Receive Life Without Parole

Patterson becomes only the second woman in Australian history to be imprisoned for life without possibility of parole. The first was Katherine Knight, sentenced in New South Wales in 2001 for the murder of her partner.

Fatal Lunch in 2023

The convictions stem from a family meal Patterson hosted at her rural home in Leongatha in July 2023. Her parents-in-law Don and Gail Patterson and Gail's sister Heather Wilkinson died within days. Heather's husband Ian Wilkinson survived after weeks in hospital; Patterson was convicted of his attempted murder.

Prosecutors Sought Harsher Sentence

At an appeal hearing in August, prosecutors argued the minimum 33-year term did not reflect the "calculated criminality" of the case. The court found Patterson's intent to murder all four guests was sustained for nearly three weeks from the time she invited them.

Elaborate Deceptions and Evidence Destruction

Justice McLeish detailed an "elaborate series of deceptions," including a false cancer diagnosis to explain her children's absence, destruction of evidence, and repeated lies about the source of the mushrooms. Patterson insisted she added the death caps to the beef Wellington accidentally.

Survivor Testimony and Husband's Fear

Ian Wilkinson testified that Patterson sought advice on how to tell her children about the fabricated diagnosis. Patterson's estranged husband Simon Patterson declined the lunch invitation out of fear, later testifying he suspected she had previously tried to kill him.
