Scotland has introduced a ban on the sale of all nicotine and herbal smoking products to anyone under the age of 18, under the Tobacco and Vapes Act 2026. The legislation makes it illegal for minors to purchase nicotine pouches, strips, pearls, and any herbal products that can be smoked.
Retailer Registration and Vending Machine Restrictions
Anyone selling nicotine products must hold a valid registration by April 29, making Scotland the only part of the UK with a comprehensive register of such retailers. Vending machines are also prohibited from stocking these items, and substantial discounts on nicotine products are outlawed.
Health Officials Emphasize Protection
Public Health Minister Maree Todd said the measures aim to protect future generations from nicotine addiction, noting that nicotine pouches are gaining popularity among young people. Chief Medical Officer Gregor Smith warned that nicotine is highly addictive and can cause dependence, withdrawal symptoms, and harm to cardiovascular health and brain development in young people.
Campaigners Welcome Closing Loopholes
Sheila Duffy, chief executive of Action on Smoking and Health Scotland, welcomed the restrictions as essential steps to close legal loopholes and prevent the tobacco and nicotine industry from profiting at the expense of children's health. She highlighted the impact of nicotine on mental health and the importance of stopping free vape sample promotions.
